FolioLord

Terms of use

Last updated [date]

These terms are the agreement between you and us when you use FolioLord. They're written to be read. Please do.

1. Who we are

FolioLord is provided by [your full name], a sole trader trading as FolioLord, of [business address in the UK] ("we", "us"). Contact: [support email].

2. Who can use it

FolioLord is for landlords and property owners managing residential property in the UK, acting for their own business purposes. You must be 18 or over. During early access you may need an invite code to create an account; once FolioLord is open to everyone, anyone who meets these conditions can start a free trial.

You're responsible for keeping your password safe and for what happens in your account. Tell us straight away if you think someone else has got into it.

3. What FolioLord is, and isn't

FolioLord is a record-keeping and organising tool. It is not legal, tax, financial or lettings advice, and it doesn't replace a solicitor, accountant or letting agent.

Laws and rules for landlords change. We work to keep FolioLord up to date, but we can't promise it reflects every change the moment it happens.

4. Your information, and your tenants' information

Everything you put into FolioLord stays yours. You give us permission to store and process it only to provide FolioLord to you. You can download it or delete it at any time from Settings.

For personal information about tenants and other people that you record, you are the controller and we act as your processor under UK data protection law. As your processor we will:

You're responsible for having a lawful basis to record your tenants' information, for telling them how you use it, and for only recording what you need.

5. Using FolioLord properly

Don't use FolioLord to break the law, harass anyone, upload anything you don't have the right to, try to get into other people's accounts or our systems, or overload or interfere with the service. We may suspend an account that does.

6. Price, free trial and subscription

Early access. Accounts created during early access are free until subscriptions start. We'll tell you at least 30 days before then, and your free trial starts on the day subscriptions start.

Free trial. New accounts get a free trial of [30] days with everything included. You don't need to give card details for the trial, and nothing is charged unless you choose to subscribe.

Plans. Every plan includes every feature. The price depends only on how many properties you have in FolioLord, counting personal and limited-company properties together and not counting properties marked as sold. A house in multiple occupation counts as one property. The prices (we're not registered for VAT, so no VAT is added) are:

Subscription. You pay monthly or yearly in advance by card through our payment provider, Stripe; we never see or store your card number. Your subscription renews automatically at the end of each month or year until you cancel. If you subscribe before your trial ends, your first payment is taken when the trial ends.

When your number of properties changes. If adding a property takes you into a higher plan, the app tells you before you add it. The higher price applies straight away, and the difference for the rest of your current month or year is added to your next payment. If you sell or remove properties so that a lower plan applies, the lower price starts from your next renewal; we don't refund the difference for the current period. We check the number of properties each day and when properties are added or removed.

Founding members. Accounts created during early access, and the first [50] people to subscribe after subscriptions start, get [25]% off their plan for as long as they stay subscribed, including if their plan changes. If you cancel and later subscribe again, you keep the discount.

Fair use. The AI features (reading documents and receipts, and Ask FolioLord) are for your own lettings. We may limit unusually heavy use that goes far beyond what a landlord with your number of properties would need, and we'll contact you before doing so.

Cancelling. You can cancel at any time in Settings, then Profile, then Manage billing. You keep full access until the end of the month or year you've paid for, and you won't be charged again. We don't refund part periods, except where the law requires it or a problem was our fault. [Solicitor to confirm: FolioLord is for business use, so the 14-day consumer cancellation right is not offered; you can cancel at any time instead. Also confirm what the Digital Markets, Competition and Consumers Act 2024 subscription rules require (for example reminders before a trial ends or a yearly plan renews).]

If you don't subscribe, or your subscription ends. Your account and records stay. You can still see and download everything, but you can't add or change records until you subscribe. Links you've sent tenants, helpers and your accountant keep working. You can delete your account at any time.

Failed payments. If a payment fails, our payment provider tries again over the following days and we'll ask you to update your card. If payment still can't be taken, your subscription ends as above.

Price changes. We'll give you at least 30 days' notice of a price change, by email or in the app, before it applies to you. If you don't want to pay the new price, you can cancel before it takes effect.

7. Availability and changes

FolioLord is new and still being improved. We'll try to keep it running and your data safe, but we can't promise it will always be available or free of faults. We may change or remove features; if a change takes away something important to you, we'll give you reasonable notice. Keep your own copies of anything you can't afford to lose: notices you've served, signed inventories and tax records.

8. Our responsibility to you

We're responsible for loss you suffer that's a foreseeable result of us breaking these terms or not using reasonable care and skill.

Because FolioLord is a business tool, we aren't responsible for loss of profit, rent, business or opportunity, or for losses arising from you relying on a notice, figure or reminder without checking it as described in section 3.

Our total responsibility to you is limited to the greater of the amount you've paid us in the 12 months before the claim and [£100].

Nothing in these terms limits responsibility for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow us to limit.

9. Ending

You can stop using FolioLord and delete your account at any time from Settings. We may close an account that seriously or repeatedly breaks these terms, or if we stop providing FolioLord, in which case we'll give you at least 30 days' notice so you can download your data.

10. Changes to these terms

If we change these terms in a way that matters, we'll tell you in the app or by email before the change takes effect. If you don't agree, you can delete your account.

11. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales can hear any dispute, though if you're in Scotland or Northern Ireland you can also bring proceedings there.
